Third Party Neutral Services


Workplace Mediation Services

At times there will be issues that are not easily resolved without some outside help. Our Fairness Consultants are experienced and respected mediators. Whether you have a workplace harassment issue, a poisoned work environment, or simply chronic conflict among workplace participants, our Fairness Consultants can help. They will convene a mediation process that is aimed at resolving the particular disputes in question. In addition, they may offer advice on structural and other modifications to the workplace that might help deal with the underlying causes of conflict. Mediation sessions can take anywhere from ½ day to a number of days depending on the complexity of the issues and the number of parties involved.


Workplace Human Rights/Harassment Investigations and Investigator Referral Services.

There are some conflicts that simply cannot be resolved by internal measures or even by external mediators. Some conflicts require a "finding of fact" or a finding of right and wrong. In such cases workplace investigators are called in. These investigators interview the complainant and respondent and witnesses and review all appropriate documentation. Then they make a finding concerning the matter in question. They may also make recommendations for action and for structural change. Some of our Fairness Consultants are experience workplace investigators. The Workplace Fairness Institute can perform investigations or can recommend suitable investigators for such purposes.

 

Arbitration and Arbitrator Referral Services

If you are looking for competent, reasonably-priced and accessible arbitrators, the Workplace Fairness Institute can help you. Some of our Fairness Consultants are labour lawyers well versed in arbitral jurisprudence. Still others are qualified civil arbitrators who can take your employment law cases. We also refer qualified, competent, reasonably-priced arbitrators upon request.


Early Neutral Evaluations and ENE Referral Services

Sometimes in order to resolve a conflict, the parties desire to have an experienced neutral party give them an opinion about how their conflict might be dealt with by an arbitrator or by the courts. This is called Early Neutral Evaluation. Our Fairness Consultants can provide Early Neutral Evaluations on most workplace related legal issues. We also provide a referral services for competent, reasonably-priced evaluators.

Conflict Coaching and Conflict Coaching Referral Services

The Workplace Fairness Institute provides conflict coaching to managers and employees. Our Fairness Consultants will work with your employees and managers on an individual basis to make them more conflict-competent. This service is usually used in conjunction with some of the other services listed above. Or it can be used as a conflict-preventative measure.
